Please read these Terms carefully before accessing or using the Rabbit application and services. These terms and conditions (“Terms”) set out the terms applicable to the Rabbit application for users, as provided by Rabbit B.V through Rabbit Egypt L.L.C or any other affiliated or sister company (“Rabbit”). By continuing to access the application and use the services, you agree to be bound by these Terms.
Definitions
Application — the Rabbit mobile application, which avails to Rabbit’s customers the purchase of home products and their delivery to their homes, and provides smooth and smart marketing services for all kinds of home requirements and electronic commerce. The platform provides licensed entities with the ability to list their licensed products and services, in addition to providing marketing content to Rabbit’s users through it.
User / You — any natural person in Egypt, whether Egyptian or a foreigner, of at least 18 years of age, who downloads the Application on their mobile phone and completes the registration procedures (name, phone number, email address and all other required data), receives a verification code via SMS to confirm their identity, and expressly confirms having read these Terms and agrees to be bound by them. You agree to update and amend the above registration information if required from time to time according to Rabbit’s policy.
Products — any products sold from Rabbit to the customer in accordance with the applicable laws and regulations in the Arab Republic of Egypt on the Application.
Personal & Perishable Products — products stipulated in Articles 13 and 26 of the Executive Regulations of the Consumer Protection Law issued by Decree No. 882 of 2019, which cannot be exchanged or returned within 14 days from the day of receipt, including but not limited to:
- All products whose characteristics or method of packaging and sealing prevent them from being returned in their natural condition.
- All books, newspapers, magazines, digital programs and their equivalent.
- Lingerie, underwear and wedding dresses once unpacked.
- All cosmetic and beauty products.
- Jewellery and its equivalent.
- Video tapes, CDs, digital disks, information programs or printed materials if unpacked by the consumer.
Electronic Bill — the electronic bill issued by Rabbit through the Application to any customer, which includes the date, name of the customer, type, quantities and price of sold products, including the Tax Registration number of Rabbit and the Commercial Registration.
Terms of the agreement
These Terms constitute a legally binding agreement between you and Rabbit Egypt L.L.C, a limited liability company incorporated under the laws of Egypt, having its head office at 27 A Street 10, Al Mahata Square, Maadi, Cairo, Egypt, with commercial registration number 166876 (“Rabbit”). By downloading, installing or using the Application for the purposes of opening an account, accessing or using the services, you:
- Agree that you have read, understood, accepted and agreed to these Terms;
- Acknowledge that your express approval of these Terms will automatically apply once you use the Application and services;
- Acknowledge and agree that Rabbit and any of its group, sister or affiliated companies offer each of the services detailed below;
- Acknowledge and agree that Rabbit has the right to immediately terminate your access to your account in case you breach any of these Terms.
You expressly acknowledge and declare that you are the only person responsible for your data, your account and the password you entered to access your private account on the Application, and that you alone have the right to use your account. It is prohibited for any person other than you to use the account. In case of breach of any of the above, Rabbit has the right, at its sole discretion, to immediately terminate your access and these Terms.
You expressly agree that Rabbit may access some or all of your personal data available on your account and share it with Rabbit’s employees, subsidiaries or third parties for availing the services subject of these Terms, without prejudice to the applicable Personal Data Protection Law.
You expressly agree and acknowledge that Rabbit is not responsible for any marketing content of products or services availed on the Application, and that the advertising entity has obtained all necessary licenses and approvals to avail such content, without any liability on Rabbit.
Use of the Rabbit application & services
You must open an active and valid account on the Application to use Rabbit’s services, by following the steps below:
- You install the Application on your mobile phone and expressly agree to these Terms;
- You enter your user name to access your account through your email address;
- You enter your phone number;
- You enter your address in detail, and any other information requested by the Application as amended from time to time;
- You receive a verification code via SMS on your mobile number, and enter the verification code.
Once you receive the verification code and insert it, you may start browsing the Application to purchase the products.
Ordering products
After completing your registration, you can order products by following the steps below:
- You browse the Application by searching for the products you wish to purchase that are available in stock;
- You add the displayed products to the shopping cart;
- You add the delivery address;
- You view the order, choose a convenient payment method and confirm it;
- You receive a confirmation that your order has been successfully submitted.
You agree and expressly acknowledge that the products displayed on the Application are sold directly by Rabbit upon availability of the products in stock, and that the number of products in stock may be frequently updated upon availability. The exchange and refund policy of the products — whether ordinary products or personal/perishable products — shall be subject to the provisions of Consumer Protection Law No. 182 of 2018 and its Executive Regulations and any amendments thereto.
Amendment & termination
- Rabbit has the right to terminate these Terms or any services by providing you with a 72-hour prior notice on the Application or by email before the termination takes effect, without your approval; your acceptance of the Terms and continued use of the services is considered prior approval granting Rabbit this right at its sole discretion.
- Rabbit has the right to amend these Terms without your approval; your acceptance of the Terms and continued use of the services is considered prior approval granting Rabbit this right at its sole discretion.
- Without prejudice to the above termination right, Rabbit has the right to immediately terminate these Terms or any services with respect to you, or generally cease offering or deny the sale of such products or any portion thereof, at any time in case of your breach of these Terms.
Closure of the account for non-use
Your account will remain valid for 12 months from the date of last use of the Application. In case you do not use the account for more than 12 consecutive months, the account may be automatically closed.
Customer identification, fraud & data protection
You expressly agree and acknowledge that, to ensure your security, prevent fraud or identity theft, and comply with Personal Data Protection and Anti-Cyber Crimes laws and regulations (as applicable), Rabbit will request information from you at the time of opening your account to confirm your identity, to allow you to open and maintain an account, and to use the services. Rabbit may also request you to update and verify your information from time to time. This is one way that Rabbit can ensure that the only person who can access your account is you. Rabbit may delay your access to the Application and services until you comply with this information request or other verification steps that may be required at any time.
Rabbit services
Rabbit reserves the right to modify the scope of services to include additional services and/or products or conditions. The Application may only be used in Egypt.
Payment policy
You expressly agree to pay for the products or services requested from Rabbit in cash or by debit or credit card at POS machines upon delivery, or before or after receiving the service, as the case may be, according to the payment terms of each. You agree to add your bank card details on the Application (if applicable) for online payment options through Rabbit’s licensed Payment Service Providers.
Cancellation, exchange, refunds & returns
You agree to the following cancellation conditions:
- You have the right to cancel your order through the Application without paying any fees, as long as the order has not been dispatched.
- In case the order is dispatched and has not yet been received, you shall pay a cancellation fee not exceeding 10 EGP.
In all cases, and without prejudice to Consumer Protection Law No. 182 of 2018 and its Executive Regulations and any amendments thereto:
- You have the right to inspect the products at delivery time and to return any of them with the delivery person; the returned products shall be discounted from your purchase cart and you shall only pay for the products you received.
- You have the right to exchange or return the products within 14 calendar days from the day of receipt.
- In case you purchased personal/perishable products, they can be exchanged or returned only according to the conditions of Consumer Protection Law No. 182 of 2018 and its Executive Regulations.
In case of return of products, Rabbit shall return the products’ price using one of the following methods:
- If you purchased via bank debit or credit cards, a refund shall be made to said cards through the Payment Service Providers contracted with Rabbit, within the duration needed by banks according to industry practice.
- If you paid cash on delivery, a refund of the same amount shall be reflected as a credit on your Rabbit account, enabling you to purchase any products displayed on the Application, from the date of receipt and inspection of the returned products by Rabbit.
Ownership
You hereby acknowledge that Rabbit is the sole owner of the Application and any related services.
Applicable law & dispute resolution
These Terms and Conditions shall be subject to Egyptian law. The parties have agreed that any dispute arising out of or in connection with these Terms shall be referred to and finally determined by the competent Egyptian Courts.
